Preparing to bid public work in NJ
By Mehal Construction Corp. · Updated October 2026 · 7 min read

Key points
- Register with the NJ Department of Labor's Public Works Contractor Registration (PWCR) before you bid on prevailing wage work.
- Most bid forms are due with the bid; some registrations are due before award.
- Prevailing wage applies to municipal public works of $19,375 or more (as of July 1, 2024) and to work for other public bodies of $2,000 or more.
- For federal work, register in SAM.gov and renew every 365 days.
Public work in New Jersey runs on paperwork and deadlines. A missing form or an expired registration can get a low bid thrown out. This checklist covers the registrations and documents contractors deal with most often on local public construction bids, and when each one is due.
Registrations to have in place
- Public Works Contractor Registration (PWCR). Required to bid on and work on New Jersey public works subject to prevailing wage. Named subcontractors must be registered at the time of the bid; other subcontractors before they start work. The Department of Labor says a certificate is mailed within 30 days of receiving a complete application, and a pending application doesn't count, so don't wait until bid week.
- Business Registration Certificate (BRC). Issued by the NJ Division of Revenue. Contractors and subcontractors need it to do business with New Jersey public agencies. Under the Local Public Contracts Law it's due before award. Contracts under 15% of the agency's bid threshold are exempt.
- SAM.gov registration (federal work). There's no fee to register. It gives you a Unique Entity ID (UEI) and must be renewed every 365 days to stay active.
Forms usually due with the bid
Under the Local Public Contracts Law, these are commonly required with a construction bid. Missing ones can make a bid non-responsive:
- Statement of ownership disclosure
- Acknowledgment of addenda
- Bidder's checklist
- Bid security (bid bond), as the bid documents require
- Consent of surety
- List of subcontractors for specialty trades named in the bid documents (not used on road work)
Always follow the bid documents' own checklist. It controls over any general list.
Due before award and before signing
- Business Registration Certificate
- PWCR certificate
- Federal non-debarment certification
- Prevailing wage rates certification
- After notice of award and before the contract is signed: the Affirmative Action Employee Information Report (Form AA-201) for construction contracts

Prevailing wage and certified payroll
New Jersey's Prevailing Wage Act applies to public works at or above set thresholds. As of July 1, 2024, that's $19,375 for municipalities and $2,000 for all other public bodies. On covered jobs, workers are paid the prevailing rate for their craft and region, and contractors submit certified payroll records. The Department of Labor says certified payroll is due within 10 days of paying wages.
Bid and quote thresholds (local contracting units)
As of July 1, 2025, the bid threshold for local contracting units under the Local Public Contracts Law is $53,000 with a Qualified Purchasing Agent and $17,500 without one. Below the bid threshold, purchases over 15% of it ($7,950 with a QPA) generally need quotes. This affects whether a job comes out as a formal bid or a quote request.
A simple pre-bid checklist
- Read the full bid package and every addendum
- Attend the pre-bid meeting or site visit, if there is one
- Confirm PWCR, BRC and insurance are current
- Line up your surety early for the bid bond and consent of surety
- Get subcontractor quotes and confirm their registrations
- Check the bid documents' checklist line by line before sealing the envelope
- Submit on time, in the format and place the documents require
